Please read these Terms of Service carefully before using icsDataView. By creating an account or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of icsDataView ("Service"), operated by ICS ("we," "us," or "our"). By registering for an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

icsDataView is a cloud-hosted platform that allows users to connect devices, ingest process status data, and view readings through a web-based dashboard. Features include device management, real-time data visualization, and subscription-based billing.

3. User Accounts

To use the Service you must register for an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security of your password and not share your credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to terminate accounts that we determine are being shared among multiple individuals or used in violation of these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Transmit malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service in a way that could damage, disable, or impair it

5. Subscriptions and Billing

Certain features of the Service require a paid subscription. By selecting a subscription plan, you authorize us to charge your payment method on a recurring basis at the rate disclosed at the time of purchase.

  • Billing cycle: Subscriptions are billed monthly or annually depending on the plan selected.
  • Cancellation: You may cancel your subscription at any time. Access continues through the end of the current billing period; no partial refunds are issued.
  • Price changes: We may change subscription prices with at least 30 days' notice. Continued use after the notice period constitutes acceptance of the new price.
  • Failed payments: If a payment fails, we may suspend or terminate your access to paid features until payment is resolved.

All payments are processed securely through Stripe. We do not store your payment card details.

6. Data and Privacy

By using the Service, you grant us a limited license to store and process the data you submit (including device readings, settings, and account information) solely for the purpose of providing the Service to you.

We do not sell your data to third parties. Data you submit remains yours. You may request deletion of your account and associated data at any time by contacting us.

We implement reasonable technical and organizational measures to protect your data, but cannot guarantee absolute security of data transmitted over the internet.

7. Third-Party Services

The Service may interact with third-party platforms for payment processing (Stripe) and other operational needs. Your use of any such services is subject to the respective third party's terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.

8. Intellectual Property

The Service, including its software, design, and content, is owned by ICS and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited license to use it as described herein.

You retain ownership of any data you submit to the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

You may terminate your account at any time by contacting us or using the account deletion option in your settings.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If changes are material, we will notify you by email or by a prominent notice in the Service. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Minnesota.
